Gaylynne's Commissions Terms and Conditions!PLEASE NOTE THAT THIS IS FOR AFTER YOU HAVE REQUESTED A COMMISSION. This is NOT for REQUESTING a commission. If you want to REQUEST a commission, please contact me at [email protected] or on Discord at GaylynneQT.This is for the protection of both me the creator and you, the commissioner, of both our time, money, and effort.
First Disclaimer
Creating art and writing is not my full time job. I attend school and work a job, as well as having other exterior commitments. As a result, this means that I don't have as much "art time" as other artists that you may have seen or commissioned in the past. As such, there may be delays in finishing your commission that may be hard to predict. I will always do my best to inform you of delays. If your commission is time-sensitive, do let me know BEFOREHAND so we can discuss more details!
Clairty
Please ensure that your request is as clear as possible when you describe the commission. Any small details that you want added, you have to tell me or I won't know to add them. I will create what you ask me, but know that any considered "blank areas" of details, I will fill them in however I see fit. Once I have started the commission, I can make small changes, but big ones that require remaking large portions require more time. So please be as clear as you can! If it helps, feel free to send pictures, samples, or other references of what you want! They will be very helpful
Payment
Payments for the commissions with be done primarily through a Paypal Invoice. If you do not have Paypal, the alternative is Venmo. You will provide me the email address/username and I will send you the invoice. If you do not have Paypal or Venmo, then I am sorry, but I cannot do your commission then.You will receive it from the account "Fair Dreams Studio." The payment plan will vary depending on the medium that you are requesting.
For Writing:
The payment plan will start with an initial downpayment of one-third of the estimated cost. Once the downpayment has been sent, I will begin writing your commission.Once the piece is around half the word count of the final total, it will be sent to the commissioner be approved. The commissioner then can tell me about any details or changes they would like to see. Once the first half of the piece is approved, another one-third of the estimated final price will be then invoiced before moving onto the second half. At any point, you are allowed to request an update.When the final piece is finished, you will be invoiced for the remaining one-third of the final payment price. This invoice will occur BEFORE you are sent the final product. After the payment is received and the final piece is sent, the commissioner may request small/minor adjustments to the piece. At any point, you are allowed to request an update.
For Artwork:

Once the down payment has been sent, I will begin the sketching out the design.Once the final sketch is finished, it will be sent to the commissioner be approved. The commissioner then can tell me about any details or changes they would like to see. The final sketch is reflective of the line art of the final piece. Once the final sketch is approved, another one-third of the final price will be then invoiced before moving onto the final product. At any point, you are allowed to request an update.
Failure to comply with the aforementioned payment terms within 7 days of a due date can result in the forfeit of all rights to the commissioned work. In such a case, all rights covered under the copyright usage section of the contract will revert to the artist and the transaction will be terminated. No refunds will be issued.When the final piece is finished, you will be invoiced for the remaining one-third of the final payment price. This invoice will occur BEFORE you are sent the final product. After the payment is received and the final piece is sent, the commissioner may request small/minor adjustments to the piece. At any point, you are allowed to request an update.

Avatars and Logos for personal identities are considered PERSONAL USE and are NOT considered to be commercial use. If you are unsure if your use counts as COMMERCIAL USE, then please contact Gaylynne.
For Personal Use Commissions:
The commission will be used for PERSONAL USE only. This means that it will NOT be used for advertising, marketing, or other activities that result in the profit of the user. Avatars and Logos for personal identities are considered PERSONAL USE and are NOT considered to be commercial use. If you are unsure if your use counts as PERSONAL USE, then please contact Gaylynne.
COPYRIGHT/USAGE POLICY:
I, Gaylynne Quince, the artist/author, claim the rights to the produced piece, not the buyer. I claim copyright over the piece, not the buyer.
Therefore, I am allowed to use the copyrighted commission pieces to:
- Promote myself with it everywhere
- Publish books with it
- Display it everywhere to my liking
- Post it wherever I want
Buyer Permission Policy:
As the commissioner/buyer of the piece, you are allowed to:
- Use the commissioned piece for personal use. It can only be used for commercial use if you specifically have stated to use it for that purpose.
- Print any artwork and claim the characters IF and only IF they are your own characters. You cannot claim the artwork itself as your own creation.
- Print any written work and claim the characters IF and only IF they are your own characters. You cannot claim the written piece itself as your own creation.
- Use the piece to promote yourself. You are not forced to give me credit when and if you post it, but it is very much appreciated.
Copyright Infringement Policy:
The following is considered Copyright Infringement:
- Reproducing/using the copyrighted piece commercially if not having been stated to be used for commercial means
- Claiming the pieces/work as your own
- Removing my signature from the artwork
- Altering the written work without my consent
- Altering the artwork without my consent
Refund Process
After discusssion with me, if you are eligible for a refund, then I will transfer the money back to you. Do NOT request a Paypal chargeback. I repeat, I will transfer the money back to you myself. If you request a Paypal chargeback at any point, even when you were allowed to ask for a refund, you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
Refund Policy:
As you are buying a commission from me, you are paying for the production of a wholly original piece made by me, Gaylynne Quince. If, once the commission is fully completed, you feel unsatisfied with the end product, you are NOT eligible for a refund as the job has already been completed and with a previously approved check-in.As mentioned in a previous section, there will be in-progress checks to make minor changes and get your approval. Reasons of "It's not what I thought it would be," or "I don't like it," do not entitle you to a refund.Please take a moment to look through my art and writing to familiarize yourself with my final products and what you can expect from the finished product.
Refund Process

Refund Eligibility
The only time that you are eligible for a refund of all the money you have sent so far is in the event that you have not heard from me within 21 days of our last communication, or 7 days if you reached out to me for an update. If this time period passes, you are entitled to a full refund and for the commission to be terminated. This is to protect you, the commissioner, from being ghosted or your commission being lost among other works.You are also entitled to a refund and termination if we make a mutual agreement on a reasonable deadline for the commission and I fail to meet it. If it looks like I'm not able to meet the agreed upon deadline due to outside circumstances, I will let you know as soon as possible.
The Final Part
If the buyer breaks any of the parts of the Terms and Conditions stated throughout this form, they will lose all the beforementioned rights to the artwork/writing commissioned by me, Gaylynne Quince (the artist/Author), and I will have the right to profit further from the commissioned artwork in any way I see fit.
